Please read these Terms carefully. They include a binding arbitration agreement, a class action waiver and a jury trial waiver (see Dispute resolution). Unless you opt out of arbitration, these provisions limit how disputes between you and us are resolved.
1. Accepting these Terms
These Terms and Conditions ("Terms") govern your use of https://tikketfymarketplace.com and any related website or app that links to these Terms (together, the "Site"), operated by TikketFy Com LLC ("TikketFy Marketplace", "we", "us" or "our"), and any services you use through the Site (the "Services").
Our Privacy Policy forms part of these Terms. By using the Site or buying tickets through it, you agree to these Terms. If you do not agree, do not use the Site.
"You" means the person using the Site. If you use the Site for a company or other organization, you confirm you can bind that organization to these Terms, and "you" includes it.
Some Services may come with extra terms that we show you before you use them ("Supplemental Terms"). If Supplemental Terms conflict with these Terms, the Supplemental Terms apply to that Service. Nothing in these Terms limits rights you have under applicable law that cannot be waived.
2. How the marketplace works
TikketFy Marketplace is an online marketplace where you can find and buy tickets and related items for live events (each a "Ticket"). We are not a box office, venue, promoter or event organizer. Tickets are sold by third-party sellers, including event operators, promoters and resellers ("Sellers"), and checkout is processed through the TikketFy ticketing platform.
- No endorsement. Listing a Ticket or event on the Site does not mean we endorse it or that the event's organizers sponsor or are affiliated with us, unless we say so.
- Seller pricing. Sellers set their own prices. A Ticket may cost more or less than the price printed on it ("face value"). Unless the law requires it or the listing shows it, we may not know the face value. Prices are shown in US dollars unless stated otherwise.
- Event information. Event details such as date, start time, venue and performers come from organizers and Sellers. They can change without notice, and we do not control those changes.
3. Buying tickets
When you place an order, you agree to buy the Tickets from the Seller at the price shown, plus any fees, delivery charges and taxes. You are responsible for giving us accurate and complete order details, including your name, email and, where needed, a delivery address. Errors may delay or cancel your order.
Order confirmation
Every order is subject to confirmation by the Seller. If the Seller cannot fill your order at the listed price and quantity, the Seller may supply comparable or better seats at the same price. If that is not possible, we will not charge you, or we will refund the full amount you paid, and we will let you know.
Seat locations
Listings show the section and row but may not show exact seat numbers. When you buy two or more Tickets in one order, they will be seated together unless the listing says otherwise. General admission and standing-room Tickets have no assigned seats.
Listing notes
Some listings include notes about the Tickets, such as an obstructed or limited view, age limits or other restrictions. Notes shown before you buy form part of the listing and are not grounds for a refund.
Ticket limits and automated buying
Some events limit how many Tickets one customer may buy. We may combine orders across sessions and accounts to enforce those limits and may cancel orders that exceed them. You may not use bots or other automated tools to search for, hold or buy Tickets, or hide your identity through multiple accounts, emails or IP addresses to get around limits or security measures.
Availability
We do not guarantee that every listed Ticket is available. Some Sellers may list Tickets they do not yet hold. If a Seller cannot deliver your Tickets before the event, the Seller will provide comparable or better Tickets or you will receive a full refund.
Transfers and venue rules
Tickets may or may not be transferable. Where it matters, we show this in the listing, on the Ticket or in your confirmation. You agree to follow the venue's rules. If you or your guests are refused entry or removed for breaking venue rules, you are not entitled to a refund and you are responsible for any resulting costs.
4. Final sale, refunds and event changes
All sales are final. You cannot change or cancel an order after the sale is complete, and we do not give refunds, credits or exchanges because you changed your mind. You are entitled to a refund only if:
- the event is canceled and not rescheduled;
- your Tickets are not valid for entry (see Ticket delivery); or
- your Tickets do not match the description in the listing.
If an event is postponed or rescheduled and your Tickets remain valid, you are not entitled to a refund. Refunds may exclude delivery charges where the Tickets were already delivered. Where local law gives you broader refund rights (for example, for events in certain Canadian provinces or US states), those rights apply.
5. Prices, fees and taxes
You pay the Ticket price shown in the listing plus any service fee, delivery charge, payment surcharge and taxes that apply. Service fees and delivery charges help cover ticket operations, fulfillment and customer support. We show you the total before you confirm your order.
6. Payment and disputed charges
You must pay with a valid payment card or other method we accept. By placing an order you authorize us, the Seller and our payment processor to charge your payment method for the full order total at the time of purchase.
You agree not to file a chargeback for a valid charge made under these Terms. If you dispute a charge and the card issuer finds it valid, we may recover the amount and related fees by lawful means, cancel pending orders, block future purchases from the related accounts and cards, and relist the Tickets in question.
To protect against fraud, we may ask you to verify your identity before we fulfill an order, for example with a signed card authorization or a copy of a photo ID. Orders placed from outside the United States may take longer to process, and your bank may charge extra fees.
7. Ticket delivery
Sellers choose the Ticket format: mobile or digital (such as a QR code, barcode or PDF), physical tickets, or will call. Your confirmation shows the delivery method and the expected delivery date.
- Digital Tickets arrive by email, by transfer in the venue's or team's app, or through a similar method. Some events require you to download a third-party app to receive and use your Tickets. Delivery is complete once the Tickets are sent or transferred to you.
- Physical Tickets ship by the method you choose at checkout. Some Tickets are only available for local pickup or will call, and some ship closer to the event date.
We are not responsible if you do not accept, claim or open your Tickets after delivery, or if delivery fails because you gave us wrong contact or address details.
Tickets not valid for entry. If you are refused entry because your Tickets are invalid, contact us within 10 days of the event with written proof from the venue and a description of what happened. If we confirm the Tickets were invalid, you will receive a refund as described in Section 4.
8. Acceptable use
You agree to give us accurate information and to follow all applicable laws when you use the Site. You agree not to:
- impersonate anyone or misrepresent your connection with any person or organization;
- use bots, scrapers, spiders or other automated tools to access the Site without our written permission;
- copy content from the Site for use on another site or service;
- overload, interfere with, or bypass the security of the Site, or upload viruses or harmful code;
- frame, mirror or republish any part of the Site without our permission;
- copy, modify, sell or otherwise exploit the Site except as these Terms allow; or
- help or encourage anyone else to do any of the above.
If you break these rules, we may suspend or end your access to the Site and use any other remedies available to us.
9. Ownership of the site
The Site and its content, including text, graphics, logos and software, belong to TikketFy Com LLC, TikketFy or our licensors and are protected by intellectual property laws. You may not copy, distribute, modify or display any of it without our prior written permission, except to use the Site as intended. We reserve all rights not expressly granted.
10. Emails from us
We send emails about your orders, and we may send promotional emails about events and offers. You can stop promotional emails at any time with the unsubscribe link in each email. Order and service emails will continue while you have active orders.
11. Third-party links and services
The Site links to and relies on services we do not control, including the TikketFy checkout, payment processors, venue and team apps, and other websites. We are not responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
12. Disclaimers
YOU USE THE SITE AND SERVICES AT YOUR OWN RISK. TO THE FULLEST EXTENT THE LAW ALLOWS, WE PROVIDE THE SITE AND ALL CONTENT "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT PROMISE THAT THE SITE WILL BE ACCURATE, COMPLETE, SECURE, UNINTERRUPTED OR FREE OF ERRORS OR HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, TIKKETFY COM LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE KNEW SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $200. THESE LIMITS APPLY TO ANY TYPE OF CLAIM AND SURVIVE THE END OF THESE TERMS.
14. Indemnity
You agree to defend, indemnify and hold harmless TikketFy Com LLC, its affiliates, and their officers, directors, employees and agents from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or the rights of others. We may take control of the defense of any such claim, and you agree to cooperate. You may not settle a claim covered by this section without our written consent.
15. Dispute resolution and arbitration
Informal resolution first
Before starting arbitration, the party with a claim must send the other a written notice describing the claim, the relief sought, and their contact details. Send notices to us at info@tikketfy.com. We will send notices to the email address linked to your order. Both parties agree to meet by phone or video to try to resolve the dispute. If it is not resolved within 30 days, either party may proceed as described below. Deadlines are paused while this process runs.
Agreement to arbitrate
Except for claims that may go to small claims court, intellectual property claims, and claims the law does not allow to be arbitrated, you and we agree to resolve any dispute arising from these Terms or the Site through binding arbitration before a single neutral arbitrator, administered by JAMS under its Streamlined Arbitration Rules (and its Mass Arbitration Procedures where 15 or more similar claims are filed by coordinated counsel). The Federal Arbitration Act governs this agreement. Claims must be filed within one year after they arise. Each party pays its own attorneys' fees unless the arbitrator or the law provides otherwise. The arbitrator's award is final and may be entered in any court with jurisdiction. Arbitration proceedings are confidential.
Your right to opt out
You may opt out of this arbitration agreement by emailing a signed written notice to info@tikketfy.com within 30 days after you first use the Site or after the "Last updated" date above, whichever is later. Opting out does not affect any other part of these Terms.
Class action and jury trial waiver
TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION.
Governing law and venue
Where state law applies, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. If the arbitration agreement does not apply or is unenforceable, any lawsuit must be brought in the state or federal courts located in Dallas County, Texas. Either party may ask a court for emergency relief to keep the status quo while arbitration is pending.
16. Changes to the site and these Terms
We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms. Changes take effect when we post them, and the "Last updated" date will change. Disputes are governed by the version of the Terms in effect when the dispute arose. If you keep using the Site after an update, you accept the updated Terms.
17. General terms
- Entire agreement. These Terms, the Privacy Policy and any Supplemental Terms are the entire agreement between you and us about the Site.
- Severability. If a court finds any provision unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect.
- No waiver. If we do not enforce a provision, we do not give up the right to enforce it later.
- Assignment. We may transfer our rights and duties under these Terms. You may not transfer yours without our written consent.
- No agency. These Terms do not create any partnership, joint venture, employment or agency relationship.
- Feedback. If you send us ideas or suggestions, we may use them freely without any obligation to you.
